Some Reasons for Terminating Parental Rights

The state or parent can petition to have parental rights terminated because the other parent:

  • Abandoned or left the child in the possession of a third party for an extended period of time
  • Placed the child in physical or emotional danger
  • Abandoned the mother during pregnancy
  • Kept the child out of school for an extended period of time
  • Was convicted of a crime involving the serious injury to or death of a child
  • Failed to obtain drug or alcohol treatment as ordered by the court

Termination for these and other reasons will result in the placement of the child by the Department of Protective and Regulatory Services. The child may be assigned to the other parent or may be placed in foster care, depending on the circumstances. Individuals whose parental rights may be terminated should seek legal counsel if they wish to contest the termination.

Adoption

Another reason for terminating parental rights is the adoption of a child by a nonparent. When a grandparent, stepparent or foster parent wishes to adopt a child already in his or her care, the parental rights of either the biological parents or one parent (in the case of stepparent adoption) must be terminated.
